UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL WE, OUR SUBSIDIARY AND PARENT COMPANIES OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE SITE, INCLUDING ITS MATERIALS, PRODUCTS, OR SERVICES, OR THIRD-PARTY MATERIALS, PRODUCTS, OR SERVICES MADE AVAILABLE THROUGH THE SITE, EVEN IF WE ARE ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH DAMAGES. (BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN CATEGORIES OF DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH STATES, OUR LIABILITY AND THE LIABILITY OF OUR SUBSIDIARY AND PARENT COMPANIES OR AFFILIATES IS LIMITED TO THE FULLEST EXTENT PERMITTED BY SUCH STATE LAW.) YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT WE ARE NOT LIABLE FOR ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF ANY USER. IF YOU ARE DISSATISFIED WITH THE SITE, ANY MATERIALS, PRODUCTS, OR SERVICES ON THE SITE, OR WITH ANY OF THE SITE’S TERMS AND CONDITIONS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE AND THE PRODUCTS, SERVICES AND/OR MATERIALS.

THIS SITE IS CONTINUALLY UNDER DEVELOPMENT AND COMPANY MAKES NO WARRANTY OF ANY KIND, IMPLIED OR EXPRESS, AS TO ITS ACCURACY, COMPLETENESS OR APPROPRIATENESS FOR ANY PURPOSE.

PARTICIPANT ACKNOWLEDGES AND AGREES THAT NO REPRESENTATION HAS BEEN MADE BY COMPANY OR ITS AFFILIATES AND RELIED UPON AS TO THE FUTURE INCOME, EXPENSES, SALES VOLUME OR POTENTIAL PROFITABILITY THAT MAY BE DERIVED FROM THE PARTICIPATION IN THIS PROGRAM.

By Booking an Appointment with The Organic Glow, You Automatically Consent and Agree to the Following:


• Caution – The effect of the spray tan ingredient DHA (Dihydroxyacetone) on pregnant or nursing mothers and their babies is unknown. Pregnant or nursing women should therefore consult their physician before their session.
• Warning – The spray tan ingredient DHA (Dihydroxyacetone) has been approved only for external application and should not be inhaled or ingested internally.
• Warning – This product does not contain a sunscreen and does not protect against sunburn.
• Repeated exposure to the sun of unprotected skin while sun tanning may increase the risk of skin aging, skin cancer and other harmful effects to the skin even if you do not burn.
• Spray tanning is accomplished in part by application of a solution containing the active ingredient DHA. According to the FDA (Food and Drug Administration), DHA is a color additive for use in imparting color to the human body. However, its use in cosmetics -- including sunless "tanning" products -- is restricted to external application.
• The solution used at The Organic Glow is hypoallergenic, and is all-natural; therefore an allergic reaction is highly unlikely. However, you do assume that there is a very small risk for a reaction to the solution and waive The Organic Glow of any liability relating to such a reaction.
The FDA advises that spray tan users should avoid inhaling or ingesting DHA or letting the spray get into your eyes. When using DHA-containing products as an all-over spray or mist, it may be difficult to avoid exposure in a manner for which DHA is not approved, including the area of the eyes, lips, or mucous membrane, or internally. Therefore, it is recommended that you take protective measures to eliminate eye contact, inhalation or ingestion during your spray tan session, such as:

• Using protective eyewear
• Wearing nose filters
• Sealing lips with lip balm
• Using protective undergarments

Male clients are required to wear undergarments. Female clients may wear whatever they feel comfortable with. You may bring/use your own protective items. Protective items are not provided by The Organic Glow.
The spraying process will take approximately twenty (20) minutes. After spraying, you will dry approximately five (5) minutes before putting your clothes back on, and you should not shower, bathe or sweat excessively for between 30 minutes and 6 hours depending on the solution and, your skin tone and the shade you're going for. 

The bronzing and tanning solutions used during your session have the potential to stain clothing. We recommend that you wear something dark in color that can be stained without concern. Cotton clothing is less likely to stain. After your tanning session, you should wear dark, loose fitting clothes.
It is also possible that the tanning solution may transfer to other clothing, furniture or car seats after your session. Washing or dry-cleaning will usually, but not always, remove the color.  The Organic Glow is not responsible for potential stains to clothing or upholstery. Please be careful.

PARENT / GUARDIAN CONSENT (if client is under the age of 18)
Because the spray tan client is under the age of 18, a parent or legal guardian must also read and understand the above information and provide their consent and approval for the tanning session. The Organic Glow  reserves the right to refuse service if the parent/guardian is not present to provide consent prior to tanning session.

CANCELLATION POLICY

 

The Organic Glow has a Booking Policy designed to protect not only our business' bottom line and in turn, our affordability, but also to keep things fair for all clients.

No shows and last minute cancellations enormously disadvantage our business.  They also mean that other clients cannot book those time slots with us.  50% deposit required for all group tanning sessions and is non-refundable if spaces are not cancelled within 24 hours prior to the scheduled appointment. 

For cancellations, please contact us at least 24 hours in advance to avoid being charged. Clients cancelling within less than 24 hours of their scheduled appointment will be required to pay 50% of the service in order to continue booking at The Organic Glow. Please see “Groups and Tanning Parties” below for more information on our cancellation policy for groups. If you cancel within 4 hours of your scheduled appointment you will be required to pay for the service IN FULL in order to re-book with The Organic Glow. Please note that cancellations can only be done via text or by speaking to your technician. We DO NOT accept cancellations by email. No Shows If our technician has already reached the venue and you do not show up for your scheduled appointment, you will be subject to pay the FULL AMOUNT of the service. You will be also be required to have a credit card on file to secure any future bookings. Clients who do not show more than once will be required to pay in full before any future appointments. Payment Policies We have a no refund policy on spray tan services completed. We must be notified within 24 hours of any problems or concerns. We offer complimentary fixes within 24 hours of the spray tan completion pending management approval and availability. If you're unavailable for a spray tan fix within the first 24 hours, we must be notified of your concerns within that first 24 hours.

There are absolutely no exceptions to this new policy. No matter how good a client is, no matter how long they’ve been with us and no matter how small the appointment booking is. One rule. For all clients. No exceptions.

What we will allow however is that they are more than welcome to offer their appointment to a friend, associate or family member if they cannot make their appointment to avoid any fees.
